When you have more time, I suggest you complain again to the landowners. Ask them to supply the name of the person who will be attending court as a witness. Please do ensure you complain to your MP as well.

Very good as long as this sentence below (and these exhibits) are removed and kept till WS & evidence stage:
The Defendant will rely upon the judgments of Pace vs Mr N (2016) and Link Parking vs Ms P (2016). (Appendix D and E)

As I am submitting the defence online, how do I include Apendix C with the Defence. A and B are embedded in the defence, but C is a 7  page document. Do I just upload it as a seprate attachment if that possible?

    Thanks

You arent uploading anything anywhere. You are not submittign the defence online.
The instructions are utterly explicit. You will be EMAILING your defence as a PDF. You obviously include appendix C as a second attachment.

Ah yes of course email it and attach a a second one. Although I have just seen on Bargepoles Court Claims precedure thread he said to print and post it registered,  so is it worth doing both?
What email address is the correct one to send the defence? I searchd the forum and found 3 different but similar ones: CCBCAQ@Justice.gov.uk / ccbc@justice.gov.uk and ccbcaq@hmcts.gsi.gov.uk
    Thanks

Thanks, but I have trawled through it several times and can't see the email address for the CCBC on it. I have found those other 3 on different threads linked from Newbies though, but couldn't say what is the correct or most up to date.

You really don't need to do much trawling.

Thanks, for making it clear. That is where I got that email address from, but it gets confusing when you read hundreds of things and find different ones and yoj forget where you found stuff from!  Appreciate the clarification though!

I shall crack on and submit my defence!
  • Hi guys, I didnt get around to emailing it off last week. Was just about to do it now, but I have just realised I don't think anyone picked up on something I mentioned in the first post. I was issued 4 PCNs, but the court claim and all previous debt recovery letters, LBCs and the the LoC have only been coming at me for 3 of them, the latter of the 3. I don't want them to eventually clock on that they have missed one out and go through this again. So should I be mentioning this somwhere so that the PCN they seem to have missed out, can be incoporatd into this case and hopefully be dismissed along witht he other 3?

    Thanks

Check the status of that missing PCN on their website by trying to pay it - obviously don't, just go through the initial proceedings to get you to the status page.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
