I had an accident last year and I received a letter this week saying that they are going to court because they other party is refusing to pay the repair costs/hire costs.

ive never had to deal with anything like this, so wanted to know if I have to go ahead with it, can they charge me for their repair/hire fees if I don’t go to court.

Also I didn’t do the claim with my insurance company, I did it through a third party.

Also could I contact my insurance and ask them to intervene or advice on what to do?

  • How many parties are involved?
Did you tell your insurer you had the accident at the time?

Will you actually need to go to court ? My son was named in court claiming against the third party.  He only found out because I saw his name on the court roll, he new nothing about it and was never actually called.  It is likely simply over the costs of the claim rather than liability.  If you fail to cooperate they can refuse to cover you for those costs and you could end up footing the bill.

Why did you use a 3rd party company rather than your own insurer? Did you inform your insurer that you had been involved in an accident?  Who is taking whom to court?
