PayPal fraud - Paypal Refusing to help

PayPal

Hey

So long story short my dads PayPal account has had a some unauthorised transactions recently totalling around £600. As soon as we noticed we contacted PayPal who suspended the account, however there fraud department have decided that these payments were “authorised” so are not investigating it any further and closed the case. The fraudster apparently accessed the account using the correct password (suspecting he fell victim to a phishing scam but can’t be certain, though fail to see how else this could have happened). For this reason they have deemed the payments as authorised and will not investigate further.

Do we have a leg to stand on to push this any further? Surely PayPal have a duty of care for fraud prevention. None of the addresses or names used were in any way linked to my dad nor would they have been made on a recognised device. I have had PayPal contact me or suspend my account even when I have genuinely ordered an item to a friends or family members addressed as a fraud prevention check.

We have contacted the bank who seem very surprised PayPal were not willing to help and are investigating and said they would contact PayPal but not holding much hope of the bank directly recovering money from PayPal

Any advice welcomed

Thanks

If you have fallen for a phishing email then no I don’t think it reasonable to expect PayPal to automatically reimburse you, all their help pages and emails carry warnings about staying safe.

However, what were the transactions for , if they were for goods then the only place they could have gone was to the address shown in PayPal and if there isn’t tracking showing delivery you can claim these back. If an attempt had been made to amend the address then notification would have been sent to the email address as well so would have been easy to stop.

  • I have had a fraudster buy good from me for £3838 he lives in Melbourne Australia, they were sold to him through PayPal last March 2019, this April 2020 he decided to do a charge back claiming the goods weren't as described when he had had the for a year, at the same time moved house so now I don't have his address. Paypal couldn't care less, they have now put me in a minus £3838 and the customer has the artwork that will increase in value and make even more money, this is totally unacceptable and I am looking for others who have been the victim of fraud to do a class action against PayPal as I have read they dont care about chargebacks because they just come after the victim for the money. THIS HAS TO STOP SO ANYONE OUT THERE THAT IS HAPPY TO COME TOGETHER TO STOP THIS PLEASE EMAIL ME  kiricat2004@gmail.com

Also any form of chargeback or case allows the seller to defend it .

    Paypal do not have chargebacks.
They have a dispute process with a timescale of 180 days.
Chargebacks are what card providers/banks do.

There is also no such thing as a class action in the UK.

There is something called a Group Litigation Order which is basically a class action suit under a different name:
    https://www.gov.uk/guidance/group-litigation-orders

A couple of examples are the cases brought against BA for their data breach a couple of years ago and a group action taken by the relatives of the Hillsborough tragedy.
