QDR solicitors letter N. Ireland

My wife just received a letter from QDR solicitors stating that she has to pay £182.00 debt for parking charge notice regarding a supermarket car park in our home town in Northern Ireland in August last year. We ignored all the original correspondence regarding the matter last year, mostly on the advice of forums that indicated that the driver was liable and not the registered owner, and they are not obligated to state who was driving. We are now concerned that they are threatening CCJ’s. 

Is it best to continue to ignore?, contact them? Or pay?

    Nobody here will recommend the last option

    If the driver has never been disclosed , then the keeper can either

    Reply back and deny the alleged debt , or , continue to ignore

    Come back if court papers arrive in the future , for more advice (it's unlikely to happen)

    Are CCJ,s even possible in Northern Ireland ??

    After all , it's not England or Wales

    If that is the case, which I doubt, they are acting illegally.  CCJs only occur when someone is taken to court,  loses,  and ignores the judge's instruction to pay.  Has this happened in your case?

  • No, we have not been in contact with anybody at all, there has not been and proceedings, in fact there was only the initial notice and one possibly two reminders, that last of which was last autumn. They are unaware as to who was driving, they only have the information obtained from DVLA.

    So follow my advice then , for when a driver has not been revealed , Keep it that way

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
