Section 75 claim - Consequential / direct losses with different credit card

Hi, I purchased outbound flight tickets for a cancelled flight with easyJet, and return flights, prepaid hotel rooms and transfers using a different credit card (used for transactions abroad).  Which credit card company should I make my Section 75 claim against? The one used to make the original flight booking cancelled by easyJet or the alternative credit card used to process the consequential / direct losses?  Also would theses additional costs for the return flights, the prepaid hotel rooms and the prepaid transfers be seen as consequential or direct losses?

    Easyjet should refund the cost of  the cancelled flights so I would not worry there.
    The hotel rooms etc you won't have  CC claim but you should absolutely claim for these on your travel insurance

    Section 75 makes the credit card company jointly liable (with the merchant) for breach of contract - or misrepresentation.

    So, if easyjet actually breached their contract with you, you could claim your consequential losses from easyjet, or from the provider of the credit card that you paid easyjet with.

    The problem is, easyjet probably haven't breached their contract with you. Their contract probably allows them to cancel your flight and just refund your ticket price.

    Best advice. Talk to the card providers. Let them make the decision.
    We take it that the hotel bookings are non refundable?
    Return flights, again airline should be refunding.

    Also travel ins should cover this.

  • Hi born_again.  Yes the prepaid rooms, and non taxes element of the return flight were non refundable.  The outbound flight was cancelled 45 minutes after its scheduled take off time, leaving us with no time to cancel the prepaid transfers.
  • Hi Edddy, EasyJet rejected our EU261 claim on the grounds that they were not responsible for the cancellation, but that was caused by a dispute by French air traffic controllers.
  • Hi - has anyone experienced credit card companies still charging interest on purchases awaiting refunds and if so can you claim back the interest based on section 75?

    For clarity with the above, may I ask if the prepaid hotel, prepaid transfers and return flights are a DIRECT loss or CONSEQUENTIAL loss following the original flight cancellation by easyJet?
  • £100 minimum claim question - I originally purchased four flight tickets costing £164 from easyJet using my Tesco credit card, and today I received a 'phone call from Tesco Bank rejecting my claim, on the grounds that each ticket cost less that £100!!
    I welcome all comments please.

    Sadly, that's the way it works.  Might be worth trying Chargeback instead?  Nothing to lose !
