So the parking company do not have an email address so you have to send everything via post or they have a contact button on there site for Gladstones.

Do you think I have a case or should I just pay it? I just feel totally out of my depth.

Everyone has a case, it is a scam   .No-one should pay unless ordered to do so by a judge.  Have you not read the stickies/newbies?   All is explained therein..  Have you complained to your MP?

We never asked people to pay , but it's a lot to learn if you want to fight it

The fact that you did nothing about the overstay , like contact them or pay extra or complain to the cinema before leaving doesn't help either , the film taking longer is one thing you should have addressed at the time

You might win on a technicality , but there isn't enough information for us to decide

Thanks for your help. I have read the stickies newbies but found really hard to navigate. I did complain to the cinema at the time and I followed the HX appeals procedure. I did not see that it had been rejected as missed the email and no letter was sent. Therefore could not follow up with a appeal through IAS as it had gone past 21 days and the company does not support this process beyond that time. It does however state on the thread not to bother with  IAS appeal as they always rejected. I want to fight the case because I feel they are unfair and that I am contributing to the problem by not contesting it. All the big retailers on that site have benefitted from the custom that the car parking encourages. Having restaurants along side the cinema promotes a longer stay for which they take no responsibility. I have complained to the MP of that area and know that there have been several other complaints raised having done a quick google search. I think thats all I can do at this stage as just don't think I have the ability to fight it in small claims. Would it be worth contacting a company to help? or should I just pay up.

I would contact the landowner or managing agent and gripe to them like you have done above

Whatever you decide , it's your decision and I for one will not make it for you

Sticky is easy to follow, get PCN, appeal using blue text template, it will be rejected, get POPLA code if BPA, appeal, Win - end of story, appeal, lose, small claims court,  If IPC, appeal, rejected, do not appeal to IAS, small claims court.  Take no action about debt collector letters, just keep them to prove unreasonable behaviour and harassment.  Wait for LOC/LBC/LBA/LBCC, and formal claim form from CCBC at Northampton, compile defence with help from forum, submit, fill in DQ, submit, allocated to court, compile Witness Statement with help from forum, submit, go to court WIN.

Whilst waiting, hammer the retailers/cinema and insist on a cancellation else, neither you, your friends, nor your family can afford to use their shops/cinema ever again if every visit comes with a £100/£160 surcharge.

Given the circumstance I think that, if they were ill advised enough to take this to court they might struggle.  .

I disagree with Redx, the car park is there for the benefit of the cinema goers, if the film overruns motorists should not be hassled thusly imo.   Have you complained to your MP?
