Strange Entry on Credit Report and Lowell CCA

Options
Having taken a free glance at my callcredit a year ago, i decided to purchase checkmyfile.com's package of all three CRA's at a cost of £15 a quarter. I may cancel in the future, but for now it is serving it's purpose.

In particular, there is an interesting sequence of entries regarding an old capital one cc.

So, according to my credit report (screen print fullsize.php?pic=86hs4y0&s=1), I opened a Cap1 account 29/08/01. This account 'closed' 05/04/03. the payment history shows as not great :embarasse , then good for last three months, then settled.
Now, I know I didn't settle this account - so I'm a little confused why it shows 3 months of good payments then a settlement?

So, onto the DCA, who have been chasing this (surprise, surprise it's Lowell - I've read allll about them:eek: ). Well I'm just about to send off my CCA request to Lowell, but don't have any correspondence or reference numbers, as I've not heard from them for years. I've not moved house, nor spoken to them.
Also intriguing is that Lowell have entered on my report that their "account" opened on the 29/08/01 - the same day my original Cap1 account opened ~ bizarre

So, my questions are:
1) what is the deal with my "fully paid" and "settled" Cap1 account, and why is it showing as paid and settled on my credit report?
2) If it is, as it shows, paid and settled, should Lowell be chasing me?
2) Should I take the CCA request route with Lowell? If so, would they be able to identify me without my reference number - i.e. with just my name and address?
3) Should Lowell fail to respond to CCA request, is it common for defaults to be removed? (I've read lots of inspiring stories, but not any success stories yet!)

Look forward to hearing from anyone with similar experience or advice,
Cheers, yorkie1980

Can anyone help with this?
  • Send them a PO for £1 (the statutory fee) with a letter requesting the true copy of the signed CCA agreement, a statement of account, and true copy of the deed of assignment to them, head the letter up ' I do not acknowledge any debt to your company', and dont sign the letter with yur usual signature, use a font from your PC
    [strike]Debt @ LBM 04/07 £14,804[/strike]01/08 [strike]£10,472[/strike]now debt free:j

    Target: Stay debt free
  • If it says the debt is settled when you have not paid then usually it means that a Debt Recovery Agency has targeted someone with similar details to you and obtained payment from them.

No it does not! It simply means that they have settled it, for instance they have decided the debt is not worth pursuing and so make it settled. There are a host of reasons but certainly not as far fetched as suggesting that someone else paid for their debt!

My mate has 2 defaults and knows for a fact he hasn't paid the debt, he then got a letter out the blue from the DCA saying that as they cannot locate him they have decided to close the account and not pursue the debt. He owed just shy of £5k so not peanuts either! His credit file did show default (with a balance) and then went to default settled - but in any case he now knows a default is bad, whether settled or not! No difference. :D

Here is template for such letter: http://forums.moneysavingexpert.com/showthread.html?t=1868507

But don't be too hasty cos I think it is Statute Barred. If so then this letter would be sent: http://forums.moneysavingexpert.com/showpost.html?p=24056639&postcount=3

Yorkie, simply question mate.... what is the default date that shows on the credit file? More importantly, when did you last make a payment? And thirdly, where are you (England or Scotland)?

I think the debt is statute barred and so Lowell are breaking the law asking you to pay - please answer above and i'll post you a letter to send them to get them off your backs and also remove the default entry (depends on date of default).

    Cheers
