Solicitor has asked for a document 16 times from seller and no response

Hi, 

I am buying a leasehold flat and am awaiting one response from the sellers solicitor via my own for the "requirements upon completion from the superior landlord". I have been asking continuously for 8 weeks if the document has been received by my solicitor but the answer is the same every time "not yet"! What can I do?! They have asked 16 times apparently... Can I go directly to the superior landlord of the property I am buying? My solicitor says no as its a conflict of interest?! And due to data protection they won't pass it directly to me.. Is this correct?! Any tips on getting this final document sorted it taken 7 months since we put the offer in and feels like someone somewhere is stalling!

    Your only recourse is with the vendor. Do they know about this problem? Have you asked them to sort it out? Give them a deadline to get it sorted or say that you will pull out of the deal. 

    The vendor's solicitor and the solicitor acting for the superior landlord are not acting for you so officially you can't complain to them, nor can they supply you with information; however, I am inclined to think that you lose nothing by writing a letter of complaint to both firms - look up the firms' complaint's process online to see who to address this to. The partner who deals with complaints will undoubtedly reply back saying that they can't respond to your complaint as you are not their customer, but magically the problem may go away once the partner has asked the solicitor dealing with the issue what the delay is....

    Is the vendor not getting impatient?
    Do you have any personal contact with the vendor?
  • We have contact with the vendor who is also asking daily for it as they wanted to be out by the end of December just like us but maybe a complaint might be in order! Thanks everyone

    Assuming you're being told the truth, the complaint should probably be made by the vendor to their immediate landlord. (There shouldn't be any need to contact the superior landlord.)

    Having said this, the "requirements upon completion from the superior landlord" would be documented in the lease you're buying - but I guess that lease might have references to the headlease. But your solicitor could just read the headlease to find out what those references are.

    Perhaps the problem is that the headlease has never been registered with Land Registry, so it's proving difficult to get hold of a copy.

    The vendor is the one who will have to complain. The vendor should get a proper update from their solicitor.

    It may be that the superior landlord is the one being slow.

    At some point, you have to accept that this document is not going to arrive, for whatever reason.

    What is the document?
    Are your lender happy to go ahead without it?

    Perhaps the OP might check  documentation at the Land Registry?
