Hi
Hope somebody can point me in the right direction as I have been doing battle now for a few months and I'm at my wits end and stressed to the hilt over it
Back in 2007 I lost my husband to cancer at a young age, I struggled with finances as none of his insurers would pay out. Buried my head and had I don't know how many debt collectors knocking on my door. I finally got myself together and slowly worked through paying my debts off. Took some time but did it apart from 3 which were charging orders placed against my property back in 2010.
I am now trying to sell my property, accepted sale in Nov 2019. My property lawyer has located 2 of the 3 charges (all charges were for Creation Financial) - all 3 were store cards.
I have now been trying to locate the 3rd charge from Creation without any success. Numerous emails have been sent but no response is had apart from the standard 'we have received your email' I have spoken to them on the phone again numerous times and each person I have spoken to have confirmed they only have 2 accounts in the system for me ( the 2 charging orders we know and accept) no 3rd.
We have sent them form DS1 to complete so the charge can be removed but 8 weeks on we have still not heard from them and still no form has been completed.
Every time I call them its the same story...we can only find 2 accounts registered with us
My question is how can I get this charging order removed? its 10 years ago and I have NO paperwork relating to it....my buyer is now considering pulling out of the sale which to be honest I don't blame him but the stress of trying to get this sorted is now affecting my health and well being.
This is the only issue holding up the exchange of contracts - its a cash sale purchase and funds have been transferred to the buyers solicitor ready to transfer to mine once we get this 3rd charge order resolved
Please help me
Thank you to anybody that can offer advice
