  • Hi all,
    I have submitted all WS and exhibit to both parties by mail on Wednesday.
    Today I have received court letter for telephone hearing.I noticed that the covering email by Coupon-mad here is not suitable for ParkingEye cases.

    Do you suggest I just send the court a simple email to say that I'm a NHS Keyworker and object the telephone hearing and prefer a hearing in person if the claim is not struck out like below, without the need of a draft order?  Or any other suggestion? 
    "If the claim is not struck out, I would prefer a hearing in person once the pandemic lockdown is lifted.  Howewer, I understand that to formally ask for an adjournment would be at a disproportionate cost which is not an option for me, so I await the court's Order and Directions."

  • Hi all, just an update, things happened quite dramatically today within few hours. 
    In the morning I've received Court Order to proceed as normal despite my objection to telephone hearing. I was disappointed 

    But few hours later PE sent a NOD to all parties !!  Thank you very much for all your support and advice. It's a win and case can finally close. Still, I shouldn't need to make things to this stage if I have followed the advice from the first post in the first page.

    This is because your email pointed out that you are an NHS Keyworker.  ParkingEye are one of the few PPCs who consider that a good reason to cancel or discontinue and move on to other victims.  Even if they should have already known this fact from defence and WS from you, the email alerted both the court and their litigation team to it and that's why they stopped.
