Holiday Cancellation and Section 75.

I purchased 2 hotel stay and Spanish Grand Prix ticket vouchers from Groupon. I paid with my credit card.
The tour operator that provides both the hotel bookings and F1 tickets when presented with the vouchers is based in Spain and is neither an ABTA nor an ATOL member.
Due to current circumstances relating to the Covid-19 virus, should either the Grand Prix be cancelled or Spain become a no-go-area, would S75 apply or would my claim be against Groupon or the tour operator?
My Travel insurance does not cover these risks.
Any information would be appreciated.

    I would say NO.
    You purchased a voucher & received a voucher. So no breech of contract there.
    Just to be 100% clear. What is the debit on your statement say for the purchase?
    Spain is not till May so plenty of time yet.

  • Statement entry is just for www.groupon.co.uk groupon.co.uk IRL, date and amount.

    No S75 at all as you paid groupon for a voucher, which you received. So there is no breech of contract. Add in there is no debtor creditor link to the tour operator.
    TBH. Not even a chargeback right as you paid for and received a voucher.
    Travel ins taken out at time of booking, is your only hope if it is cancelled.

    If the Grand Prix is cancelled, then the organisers should refund all tickets.
    You can but hope the Groupon involvement doesn't mess this up.

    If Groupon are in any way reputable they should, of course, refund any tickets bought with their vouchers that are subsequently cancelled.

    I'm wondering how you got on with this. I'm still fighting for a refund. EuroPlayas offered 90% refund in May, which they have now gone back on, and Groupon are not being helpful. I have submitted a Section 75 in last resort of getting money back. Hoping the bank will deal with.

    If You made the purchase via groupon. Then you will not get anywhere with S75 as there is no debtor, creditor link to EuroPlayas.
    You paid groupon who did what they said they would, either supplied voucher to redeem or passed the funds to the holiday co.
