statute barred ?????

Me and my partner have a few debts which we have tried to ignore for about 5 1/2 - 6 years + now,naughty i know. I was interested in the information i have found on this site about statute barred as i have never heard of this before and was hoping that it would apply to some of our old debts. I never write to my creditors so i know they have no proof so do i need to get my credit file to see when i last made payments and if they were 6 years ago as i don't remember it was so long ago. Most of our debts have been sold on now so i just chuck the letters away. If it turns out that some are 6 years old do i wait till i recieve a letter asking for money and then send them one of the statute barred template letters? Thanks for any help you can give me it's much appreciated. xx

I don't know that you'll get a lot of sympathy here. Most of us are trying to pay off our debts, not running away from our obligations and responsibilities. If you borrow money, you're supposed to pay it back - that's how the system works. I know we're asked to be nice to moneysavers, but there's a difference between moneysaving and just taking the pi$$. Sorry to be harsh, but your attitude sucks.
BTW, you can probably get out of paying what you owe under the six year statute barred thingy unless it is a mortgage or government debt.I used to think that good grammar is important, but now I know that good wine is importanter.0 -

I am not after sympathy just advice. I am trying now to deal with my debts, i was young and borrowed more than i could afford like a lot of people on here. I have a ccj and other debts which i am clearing but i am refering to debts from years back which have been sold on and on again and was just after some help to see how i could find out if they were covered under the statute barred. I don't feel my attitude sucks. My credit card company couldn't be asked to collect the debt so sold it on for peanuts to lowell who keep threating all the time so if i don't have to pay them i wont,sorry you feel that way. xx:santa2:Christmas Challenge:snow_laug

Nikki - I think the reason why got upset by your opening post was simply that many many on here are living tough lives to fix their debts and view your post Rightly or wrongly as a quick fix.
Why dont you post up your SOA so that this is the final time if you get these debts written off you never get back into the same position?
Hope you manage to sort them out and please do let these wonderful DFW's help you out.

Nikki - the last 6 years starts from the last time you acknowledged the debt.
This means the last time you made a payment towards the debt or the last time you acknowledged IN WRITING that the debt was yours. If a DCA called you and said "you know that debt you have with Halifax for £2000?" and you said yes - that does not count as an acknowledgement of the debt. If you write making an offer to pay off the debt - that is. (But if there has been any period of 6 years the debt becomes statute barred and even acknowledging the debt after that does not unbar it).
