Yes I have, did that yesterday.Castle said:
And have you contacted DVLA to find out what exactly SABA put on their request for your details?del1rious said:Thank you all. I have already made a complaint with the ICO about the personal data issue so I will report back on that.
I asked them to clarify what exactly the charge was for - to avoid criminal prosecution (fact) or as some civil contract dispute as with other private car parks (which they are now trying to indicate)
response I received was - "the £100 was the parking charge fee"
so they really have no clue or are being intentionally obtuse, which we already all knew anyway!
100% will be back for that!!1 -
This is my thinking.Fruitcake said:I suspect they are being deliberately obtuse and evasive.
It depends on how much of your own time you want to waste on this. If you keep poking them, at some point they are likely to say that they will not enter into any further discussion.
There are loads more relevant questions you could ask if you wanted to, but don't expect to get anything useful out of it.
No matter what I ask them they come back with "Railway bylaws level 3 magistrates court" "We can pursue in county court for upto 6 years"
...ad infinitum....
The other thing I may do is ask ZZPS exactly what they have been asked to pursue money for, but they will probably just punt me back to SABA. I do have a lot of free time at the moment though stuck at home with a leg injury, so we will see.0 -
If you want to spend time on this then you can ask,
In what court and for what offence would a private prosecution be made?
Is the timescale for making a private prosecution in the Magistrate's court the same as in the small claims court? If not, what are the timescales? Does the Magistrate's Act apply and if so, how can a private prosecution in the Magistrate's court be made after six months?
If the Magistrate's Act does not apply, why?
What part of the railways byelaws do you believe the keeper has breached?
How can you make a claim for breach of byelaws against a vehicle keeper?
What part of the Court Procedure Rules allows you to make a "Railway bylaws level 3 magistrates court" claim in the county court?
... and so on.

Ok I might be happy to waste further time but it appears they are not. After asking twice whether contract law or breach of railway bylaws was as play here and receiving iterations of “£100 is for breaking car park rules”, they have said they won’t answer any more questions of mine and I should contact ZZPS.
the person emailing me was a data protection officer as that’s what my original query related to so that is understandable. But it’s also laughable that SABA were happy for someone in that job role to continue engaging on a subject matter they have no expertise in.2 -

He's probably only the Data Protection Officer when someone writes to the Data Protection Officer.
The rest of his time is split between emptying the bins, making tea, and refusing appeals.5 -
SABA are happy that many motorists are unaware of the scam they operate and pay up without question. Whichever paper shuffler who writes the nonsensical responses is irrelevant. If you're happy to waste more time whilst you recover from your injury then work through Fruitcake's list to ZZPS instead. Personally I would wait and see if you get anything constructive back from DVLA/ICO and focus on your recovery. Come back here in the unlikely event any sort of proceedings are issued.del1rious said:But it’s also laughable that SABA were happy for someone in that job role to continue engaging on a subject matter they have no expertise in.4
