Please see attached all correspondence ,it is all in correct oder except for page 12 of their last letter which is between pages 16 and 17 for some reason !!
Hi everyone, I hope someone can help me as I'm out of my depth now and getting really stressed. It is an IPC not a BPA member (does that mean l can't do POPLA btw? ES Parking are PPC solicitors are Gladstones.
Works vehicle was pictured stopped in a 'no stopping at any time' place as absolutely nowhere else to pull over on a private estate and didn't see sign and hubby had to stop to ask directions to next job which he couldn't find . He asked somebody and found out his next job was round the corner and man also advised him not to stay there because of zealous PPC. This job was on the private estate where the vehicle was photographed and where the maintenance company he works for has several maintenance contracts so he had a valid reason for driving onto/being on the estate. Works vehicle is owned by a maintenance company contracted to maintain buildings in Manchester and the estate he stopped in has a management company that apparently employ the delightful ES Parking Enforcement Ltd.
Hubby works for maintenance company as a sub contractor (if that's relevant i.e. he's not employed as a driver) and he had that van that day apparently according to maintenance company's records.

First thing hubby knew was the maintenance company /RKs of the vehicle physically handed the PCN (addressed to them as keepers) to him in the depot and advised him to appeal it 'and get back to them if he lost' Now they don't want to know predictably.
He did appeal on ES Parkings own portal (so he has no record of it now but he thinks he named himself as driver even though hes not sure he was !!....and yes l want to kill him too !! ) They rejected his appeal by email and said he could appeal to the Independent Appeals Service the IAS but no mention of POPLA.
Then the very first letter he got addressed to him directly at our home address was a Letter before Claim from Gladstones solicitors. I worded a reply on his behalf and posted it to Gladstones requesting a POPLA appeal and pointing out (from stuff l gleaned from on here etc) that they had not followed pre action protocol ( they have never sent a parking notice with ability to pay the lesser amount for example directly to my husband) So I asked them to send me all correspondence copies between them and their client and all parties involved to see whether they falsely might claim they actually have sent a 'notice to driver' or even produce one and claim they'd sent it...l wouldn't put it past them tbh.
They have replied in last few days giving him 60 days to pay up or go to court basically and denied that their actions/correspondence is non compliant (and not sent a POPLA number.)but a financial statement form, a reply form saying he has 30 days to return filled in or 'could' result in court proceedings (note that contradicts their cover page of letter saying he has 60 days to give a 'substantial response' They ignored my request to send all copies of correspondence between all parties involved which I believe is part of the PD to send everything they will rely on ? We cant access the ES Parking portal anymore to see husband's appeal but basically he just told the truth as above. This means we cant also see if there's any clearer pics (if there are any) to the smaller blurry ones on the original PCN
Please can someone help me whats best to be done next as I haven't much time left (apart from murdering husband for appealing on their portal in first place)
Should we return the filled in court reply form and reiterate we want to see all the correspondence and can someone tell me please whether they do have to let you go to a POPLA appeal.not being in the BPA? Or should I hold fire on the reply form and just respond within their deadline and ask again for full list of documents as per PD
Have they have broken protocol by not sending a parking notice to my husband directly (or did that boat sail when he appealed on their portal using the NTK handed him by his 'employers' ?
I don't think PPC formally got hubby's details off the maintenance company as they merely physically handed the PCN over to him and didn't bother to fill in the Transfer of Liability and left him to it (again not sure if that's relevant).
I think the fool ( sorry but I could really murder him ) filled his address in on his portal appeal which is where Gladstones got it from or maybe Gladstones got it from DVLA ?

OK so that can be summarised as - you need a good repsonse to a letter before claim?

Has the driver been admitted? If YES then no panic, it just lets us know. Dont give more info than yes or no, btw.

Scam site, well known, and as well as several threads currently on the go here, there are also blogs you can Google from the Parking Prankster.
Luckily at Manchester court you have very clever Judges like DJ Iyer, who knows all about PPCs.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
