Barrier Telford Shopping Centre


Received parking charge notice from Smart Parking this morning.
The supposed offence took place at Telford Shopping Centre.
I was not the Driver but they did tell me that when arriving to the centre they found the barrier up with 2 men in attendance who explained that there had been an incident and just waved the driver through.
This meant that when leaving the driver had no ticket so they explained to an employee via an intercom on the car park that as they had not received a ticket when arriving, because of the problem, they could not insert a ticket into the machine to raise the barrier . He said he was aware of the problem and he raised the barrier for driver to drive through.
Now as you can't access the Telford Shopping Centre without taking a ticket nor exit without inserting a ticket then obviously the driver just followed instructions from the employees in attendance.
Your thoughts on how to handle this would be gratefully received.

I think that, if they were daft enough to take this to court they would crash and burn, so encourage them to take you to court where you can ask the judge when you win for unreasonable behaviour csts under CPR 27.14(2)(g) and/or counter claim for breach of your personal data as they had no right to ask the DVLA for it.
Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

yes , and it seems funny
obviously no one on site running round trying to catch people parking over lines , and just like my local car park , entering the ticket to machine when you leave calculates the charge , as the money will go to thew land owner , why the hell are smart on this site , as i theory they have outgoings , but no income1 -
