Section 75 - Tickets bought from Viagogo and concert cancelled

I was wondering if anyone can tell me where I stand if a concert gets cancelled due to Coronavirus? The gig isn't until July and is in the Netherlands so there's every chance that it will go ahead but I want to know where I stand if the situation comes to pass. They have, however, cancelled the rest of their North American tour so it is a possibility.
I bought tickets on Viagogo. Luckily, with the transaction being in Euros I decided to use my Barclaycard as there are no non-sterling transaction fees. As this is a credit card, if the concert is cancelled will I be able to claim under S75?
Stressing a little bit.

If the concert is cancelled - as with any Viagogo concert - they will refund to your account.

Viagogo are online ticket touts. You shouldn't be using them.

Indeed. But this is a problem with capitalism and until secondary sites are mandatorily replaced by face value only resale sites there is no other way to get tickets after an event has sold out.

I thought this but all I can find in the T&C's is:
" In the event that an event is cancelled or re-scheduled, viagogo reserves the right to cancel a seller’s transaction"
That doesn't fill me with too much confidence as a buyer though. Maybe I'm overreacting.
Interested in the general point anyway though. If Viagogo refused a refund, the CC would still have to refund, right? The pruchase being over £100 etc...

As you are not the actually purchaser of the tickets. If it is refunded by the promoter, then the refund will go the the person who bought the tickets.
You would be looking at a chargeback to claim the money back via your card provider. S75 will be a grey area as Viagogo are not the promoter of the concert, thus they are not breaching the contract. Add in you are not the original purchaser of the tickets. Far too many 3rd parties in there.

Something to be aware of with Viagogo is that many promoters will turn people away that have bought tickets from them.
Ed Sheeran started the trend. They made anyone with tickets bought from Viagogo buy new tickets and stamped the old tickets invalid. So they could claim the money back.

Sorry to revive this. Back in January (pre corona) I booked tickets for a gig in Berlin in June. Viagogo got in touch with me a few weeks ago to tell me it was rescheduled til August so I relisted the tickets as I couldn’t go then. Now they’ve got back in touch again to say it’s been rescheduled for the day after it should originally have taken place. According to the performer’s website, most of the tour is postponed indefinitely and in fact on that date they are scheduled to be in a different city though it also indicates this date is postponed.  I’m not sure how often the website is updated though, it looks quite static. It feels to me that Viagogo are misrepresenting things here. Any suggestions or advice would be much appreciated. I’ve used their message function to advise that i want a refund but I’m not holding my breath. At what point could I go to my bank and ask for a credit card refund?? Or could I do that?

For info, I didn’t know that Viagogo were ticket touts til the rescheduling issue came up, I just searched for the tickets for the gig and that’s where google took me, I thought it was like ticketmaster or something.  I don’t usually buy tickets for gigs internationally so it didn’t occur to me that this would be an issue. Of course I paid massively over face value as well i found later :(

So you are selling tickets on Viagogo?
    Why?
You are entitled to a refund for your purchase of original seller.
Or are you just hoping to make a profit.?

Viagogo have had some pretty bad press recently but I do believe that if the event is cancelled you will eventually get a refund
  • Could someone tell me where I stand with this situation please. I bought tickets for a concert to be held in June 2021 a few months ago from Viagogo.  I realised as soon as I had paid that I couldn't actually make the date due to a postponed holiday due to covid.  I phoned Viagogo  and was told they don't do refunds, I asked if they could change the tickets for a different venue, they could not.  However, I could relist them and was told to do so at a higher price than I had paid. I have not had any previous experience of this so I just went along with what they said.  Last week I received an email to say that the tickets had been sold however, I would not get my money until after the event in case there was a problem with the tickets. I hadn't a clue about what I was being told until I googled it. The question is, if there is a problem with the tickets will I get my money back next June?

If the event is cancelled, then you as the original purchaser will get a refund (eventually). This, as it happens, would suit you as you couldn't go anyway....

If the event is not cancelled, then the person you sold the tickets to will go to the concert, and Viagogo will pay you the money they paid for them.

For the sake of clarity, Viagogo, Stubhub, Ticketmaster etc are ticket resellers ie the public can re-sell any unwanted tickets on their site. Touts is a bit emotive.

A word of warning on reselling the tickets.
Some concerts will not allow tickets bought via them to enter the event as they are not authorised ticket sellers. They make people buy new tickets & then they have to claim the money back from ViaGoGo. As you can guess that is not easy, and as the reseller of the tickets you will lose the money the money anyone paid you for them.
