    I pm-Ed you the detail of my case. Quite complicated but I've think in researching I've exposed that my defence is the wrongly entered VRN by the driver and The PPCs repeated refusal to provide evidence, including the PDT log so that the claim can be defended. There is also a major issue in the way the car park operates and what steps the management don't take to protect the consumer.
    I am reporting the PPC to my MP, as this car park adjoins the Hospital for mental health, alcohol and drug abuse and having no consumer protection in place is just a 'honey trap' targeting vulnerable people.
    However, ...counter claim.
    The PPC is pursuing prosecution despite not identifying the driver, proving contract when requested or Proving a breach Occurred. The PPC has never proved the claim. I've pointed out numerous times that their claim to pursue payment of debt does not satisfy the requirement of 'reasonable belief debt is owed' as required by Administration of Justice Act 1970. Therefore, the pursuit is fraudulent and the litigation is vexatious.
    The lack of proof from the PPC appears to meet the requirements for Malicious Prosecution. Is this the way to go? If so, is that a counter claim, or a separate claim?

  • Please also complain to the DVLA for releasing personal details and subsequent harassment and anxiety.   In this case vulnerable people may become victims.

    Will take a look when I don't have a houseful of twenty-somethings doing a murder mystery party, which is what's happening in the next room right now, I am on my laptop for peace and quiet tonight!
