CCJ & Renting
Hi all,
Long story short - my partner and moved back to the UK from Australia after 4 years being there.
We applied for a house and we wanted to check our credit score. To my surprise, (I am still in shock) I have a CCJ recording dated on the 22nd of June 2016. We moved to Sydney 1st Sept 16 and the month of July August 16, we travelled in Europe to see families and friends before our departure.
I am really in shock as I always pay on time and I literally don’t know where it’s coming from. The most surreal thing is that it’s only £250. We earn over £100k a year and have 5 figures saving. So I could surely pay. I also don’t recall getting any letter from County Court.
I am really stressed that we won’t get the house because of this.
Could you please advise on what to do as it is already been 4 years and I don’t want to open a wound again.

If you have checked your credit file can you find out who took out the CCJ 4 years ago.
You will have been in Europe or OZ and not received the letters or emails
My guess is that it was a mobile phone provider or utility bill.
Can you pay it off ASAP

No, it will be marked as settled / paid etc as they stay on your credit file for 6 years from the date it was put on.Mortgage started 2020, aiming to clear 31/12/2029.0 -

Would a lawyer be in any help with this? I am financially very stable. I cannot believe what is happening...
Any advise appreciated0 -
Not a legal expert but sounds like you need to make an application to set aside the judgement. Form N244 and it should go to an oral hearing. I don't think something like this needs to a solicitor you could potentially do it on your own. If you speak to someone at the Court they might give you some help but they are not legally trained and not bound to give advice but these sorts of things are the bread and butter of the Court.FabShrew said:

If you win, the Judge should make an order to set aside the judgment upon successfull payment and then someone at the court will enter the date you paid onto the system.
I may be wrong but thats what I think will happen.0 -
My boss had a CCJ showing on his file & he appealed and had it removed.FabShrew said:

Had to go to court and was very lucky that it was removed without the help of a lawyer.
Would recommend getting a lawyer as straight facts about how you didn't receive letters didn't sway the decision for my boss.0 -
@FabShrew , I'd put even money on it being a parking penalty. If it proves to be the case, may I suggest the 'parking tickets' sub forum? There are some extremely knowledgeable peeps on there and you'll find all the advice you need to get this sorted out.
