Overseas Wedding COVID-19

Hi!
New to the forum but listened to martin's Podcast from Monday, which was helpful and touched on some aspects of what I am about to ask.

We have a little bit of a complicated situation   - due to get married in northern Italy this July. One of us has an existing medical condition which is covered by our travel insurance, but we are yet to find wedding insurance that will cover this. The condition is a congenital heart defect. No medication or treatment but being monitored annually.

Credit card query as follows:
  1. Would the credit card guarantee cover any aspect of our booking if we cancelled? Would it only be effective in the event of the government stating to not travel?
Thank you in advance for all advice

It gives you the same right against the card provider as the retailer.  It doesn't allow additional cancellation rights.

If you cancel, then no cover.
I would say if travel advice was not to go, then you would need to speak to card provider about the wedding costs. As it will be a grey area.

Good luck and I hope you do go. My hairdresser son is due to get married in Italy @ Easter.

Where exactly in northern Italy ?
FO advice against all but essential travel only covers a very small area in Lombardy region and around the city of Verona - ironically a bit of a dampner for aspiring Romeo & Juliet couples sadly.
As above - you won't be covered for travel costs if you elect not to go, unless the FO update their advice due to changing circumstances
Can't speculate on the wedding insurance aspect - you'll need to speak with companies that offer that specialist cover.
I suspect any that are willing to offer such a policy will require a hefty premium in respect of the existing medical condition.
Fingers crossed it all works out well for you both.

The quick and simple answer is, if YOU cancel you are not entitled to anything under S75

All should be back to normal by July.
So for now I would not do anything rash like cancelling anything.

Now that it is a known risk you can't get cover for it.

Section 75 specifically makes the credit card company jointly liable (alongside the merchants) for 'Breach of Contract' and 'Misrepresentation' - and nothing else.

    So if, for example:
    • The FCO tells you not to travel, or
    • You change your mind about travelling
... neither of those are 'Breaches of Contract" by the wedding venue, travel agents, airlines etc. So the credit card company has no liability, and will not refund you.

True examples of 'Breach of Contract' might be if the Wedding Venue went bust and so the wedding couldn't go ahead, or the Wedding Venue didn't do what they agreed to do in the contract.

And even if the wedding venue went bust, S75 wouldn't cover the flights, as the flights were still available and therefore no breach of contract between you and the airline.

Many people seem to think, and treat S75 as a comprehensive insurance package.

Would that make it a notifiable condition ?
