    Just saw this. I used to work in a civil court. I don't know the ins and outs as I am not a Solicitor but she definitely cannot kick you out. In fact you have the upper hand as someone else has mentioned. I can't remember entirely but I don't think she can serve a S.21 notice as she hasn't gone through proper procedure so it might be S.8 (I could be very wrong).

    Anyway! Yeh, first she has to put her claim in. That takes a few weeks(last I remember it cost £335), then you both provide statements ya di ya, get a hearing (potential delay). Even if she gets a discretionary order to kick you out, you apply to suspend the warrant. you get more time. Court bailiffs are slow they usually can't keep up. Anything from 6-9 months.
    If you are in arrears and that is the case then she could end up putting a CCJ against you if it did go that far and if you did decide to stay in the property.

    The camera, how the ell did she fit that? She has no right doing that, like someone said stick a picture of Justin Bieber in his y fronts over it. Changing the locks would have been good too.

    Overall if she has a hold on you at your job and you are afraid to lose that too then yes move on(I'd also recommend you to look for a new job as well and start a fresh.). Have you paid her upfront for rent? provided you are not in any danger then just see out your stay and get your monies worth because you won't be getting anything back from her thats for sure.

    In terms of harassment and all that. You wouldn't have much case once you're gone. 

    Edit: In the future get a proper contract and don't put yourself in a position where one individual has this much hold over you. Really look to working for a new employer mate.

    In this saga, we do not even know if the ex-girlfriend lives there or ever did, why someone can't afford to change locks one minute but is paying £500 rent the next minute, why there has been alleged police involvement, why someone is "being watched 24/7" when simple tape over the cameras is not even considered, why it is all a crisis and being homeless until 25 March one minute but O/P is now moving out next minute, why a phone call to Shelter was given up after battery failed after 30 minutes but with no further calls to Shelter after that, why someone is still threatening, bullying and treating "tenant" "like a dog" even though O/P is now safe and free within a week.............etc etc

    Coachman12, please stop with silly assumptions, you've said nothing constructive, but hey, I will answer your assumptions. I've paid 500 rent and then I don't have money to change locks 9 days later. I have no savings and I live month by month being silly with money. Obviously that's weird for you. There is police involvement because of her threats so I did informed police about it, she did not involve any police (pleas read carefully). I was watched 24/7 and was afraid to touch camera as I did touched it once, and I received threats of losing my job. A phone call to shelter was given up after battery died and I did called shelter again, maybe ask if I did ? Thank you for your help, very constructive post.
    NOW here is an update. Yesterday she threatened me again, that I have 5 hours to collect some ridiculous money for ridiculous bill that she should pay (as agreed few weeks back, that she pays electricity). I've said I have no money, and please stop harrasing and bullying me. She continue that she will make me homeless and unemployed and have no right to be there. So I've said that's enough. I've contacted police again, but this time I've said everything (harrasment, bullying, threats of loosing job, threating me like dog, illegal camera etc.). I've asked them to come after 10 pm to the flat as I'm coming back from work and I am afraid of my life. I've messaged her, that police will be attending flat to talk to me about her trying to illegally evict me, illegal camera and all of the rest of crap. So I've said she is welcome to join us and told them anything about me what she wants. Guess what I found out when I came back... All my stuff in hallway, and she changed locks. I've slept in a car, with my stuff half packed half in front of car. Now where do I go next with this ? I was at police station today reporting everything (and yesterday aswell). I guess now it's just I need to get lawyer and sue her for illegal eviction right ?

    If only you had taken advice of the knowledgeable people on here and changed the locks. You wouldn't of been in that position. 
  • I think you need to go visit the CAB. And if you work for a large company, I'd be putting a grievance in against your Manager too.
    Any evidence of that kind of threat would have someone suspended within minutes.
    Your ex has, however, overstepped the mark and sounds like she needs putting in her place.

    @diego_94 I have said that I had no money at all. I am broke and in debts, and because I was threatened I was paying her anything she wanted, just not to lose place to live.
    @newsgroupmonkey_ I don't have any evidence as she said it verbally and I don't have any records. Nothing happened at work today, so I think she might have called him but I think there's too much fuss about whole this case so I don't think my manager wants to get involved. By CBA you mean Citizen Bureau Advice ? So far I just contacted police and solicitors, but I'm still waiting for them to call me back. They just took notes.

  • Maybe I've misread somewhere but after the relationship went bad why didn't you pursue to move elsewhere with the rent that you was providing her?

    I pursued to move elsewhere, but I needed 1-2 month to get money for deposit, and I was broke. So she agreed with me that I can stay there for 2 more months. And through this time she was harrassing me for more and more money, and I was paying everything she wanted. To the point where I've paid her and 10 days later she throw my stuff away... I did not expect that she is going to change like that. Nobody ever has treat me like that.
