Reclaim PPI on joint mortgage when divorced

SKayR

I was divorced 8 years ago. We had a house with a joint mortgage with Yorkshire Building Society and I know we had PPI, which, I also know....now.....would not have paid out had we had a problem. The house was sold on our divorce
I have tried claiming PPI, however, YBS will not entertain the claim as it is from me and I have no contact with my Ex, I have no address and really want nothing to do with him. I remember seeing Martin talk about this and say that it was treating one partner unfairly so I went to the Financial Ombudsman with this argument. They took up the case and have done the preliminary work but have now come back to me to say that I need the signature of my Ex before they will take it any further
I feel aggrieved, I was the principal wage earner and more of my money went to pay the mortgage than his. When we divorced he had run up considerable debt in my name and I got this resolved with an IVA, which completed 5 years ago. We had PPI on most of the credit cards and loans we had which I have successfully reclaimed and which went towards my IVA
Is there anything I can do? I would appreciate any advice you can offer

Why not? MPPI tends to suffer fewer issues than loan or credit card PPI. So, what was the reason you think yours would not have paid out?

Most YBS mortgages were done via mortgage broker/advisers/estate agents. Was yours or was it done direct with a branch?

Whilst Martin may have said that, the FOS decision is consistent with other cases where this has been raised.

Thanks for your reply.
- From articles I have read I do not believe we would have qualified for PPI but it was added automatically
- Our mortgage was done directly with YBS
- I take your point. I have had a call from the FOS so will call them back and speak to them for advice
Thanks again0 -
Have you not missed the deadline for PPI claims?0

PPI is not the same everywhere. There are different types. Some of them were awful. Some of them were very good.
MPPI is one of two types of PPI that you can still by today. Monthly premium MPPI is how good PPI should be set up. It nearly always covers the self employed correctly.
Adding it automatically rarely ever succeeds as a complaint reason. People who have something added without knowing generally complain within a short period. The longer time goes on, the less credible that becomes as a complaint reason. i.e. if you complain in the first 6 months, you will be believed even if there is no evidence to support it. If you are complaining years later or even decades later, it has no credibility at all.
Statistically, even if they chose to look at it, most MPPI complaints fail. So, don't beat yourself up too much about it. Odds are, you wouldnt have succeeded (unless you happen to have a particularly strong reason you haven't mentioned)I am an Independent Financial Adviser (IFA).
