Conservation area

My friends buying a bungalow in a conservation area the property doesn't need any structural work doing but it doesn't have a chimney and he wants a stove so easiest way is a free standing stove with pipe straight up though ceiling and roof. He doesn't need permission for the work inside but what about the pipe sticking though the roof. It also has a 3 foot high fence around the front that is rotten can that be replaced? If it wasn't a conservation area he would just do the work has anyone had similar?

    The fence should be fine to replace.  

    The stove might need planning permission depending on what is in the Article 4 Direction for the specific Conservation Area.  Needing permission doesn't mean that it can't be done.  

    The local authority will have documents online relating specifically to that conservation area.  Your friend should look his up and then probably double check with the planning department.

    He's tried speaking to planning but they won't help unless he fills forms in and pays £75 but apart from his name nothing on the forms have anything to do with what he wants to do it's all for extensions and similar

    We are in a similar position.  Agreed he should get hold of the specific conservation plan for the area in question.  Also, find the relevant planning portal and you can see what's been approved/denied recently.  Both should be online and will give a general picture of what might be allowed.

    There will be (free) guidance somewhere, they can't just create a conservation area without justifying what features are being conserved, which types of development will require consent, etc. If you're having trouble finding it, maybe tell us where it is and someone here can dig out more useful info.

    No free guidance from the council. Looking around the village nobody seems to be taking any notice of it one even has a garden summer house in the front, if it already had a chimney the stove wouldn't be a problem. The village is Wintringham near Scunthorpe

    If they replace the fence "like for like" they shouldn't need consent.

    If they want a different style of fence, they're likely to need consent. And they might only get consent for a fence that is in keeping with the property / area / era - so it might need to be a period style fence or railings etc.

    It may be that the summer house etc, was already built when the area became a conservation area. The council cannot force people to 'undo' changes made prior to conservation area status.

    Generally speaking permitted development rights are removed, or severely curtailed, in a conservation area and hence planning permission is required for many external works.  That is not to say that consent will not be granted - much will depend on the detail , the statutory obligation on the local authority being to have special regard to the architectural and historical interest.
    If you look at the conservation area appraisal (CAA) and Supplementary Planning Guidance (SPG) linked above, you will see that reference is variously made to properties of townscape value and seperately to details of fenestration, eaves, verges or chimneystacks in new development.  Some caution may therefore be merited.
