Thomas Cook Refund

Hi, looking for advice. We had a holiday booked through Travel Dealers Travel Magic, for a trip to EuroDisney. The holiday was lost due to the demise of Thomas Cook. We made a claim through our Tesco Credit Card. The money was eventually repaid back to our credit card. But have today received a letter from Tesco saying the retailer is disputing the claim. Tesco are saying we have a valid claim, and are going to escalate on our behalf, but have said ultimately it will be up to MasterCard to rule on the dispute, and am very concerned they are going to rule in favour of the retailer and they will re-debit our account. Has anyone had this happen to them, what can I do? Any advice would be appreciated. Thank you

Would be interesting to know who the payment provider is for Travel Magic , Id try not to worry too much as Mastercard is very very consumer oriented,  so it will be hard to lose a 'services not provided' against them as you have not received the service that they advertised  and sold to you, they themselves need to claim against TC. Regardless of abta, atol or section 75  most payment providers will not take it to pre-arb, although some will try their luck through sheer volume, in a nutshell mastercard will see that you believed you entered into a contract with and paid Travel Magic and are therefore their customer and they then took your money to TC which makes THEM a customer of TCs although they won't believe that that is the case and will hide behind the t&cs on their website that by buying from them you automatically agreed to.

Take it that you have only recently made the claim then?

No, I made the original claim in September, it took ages to be settled and now they are arguing it!
