    It does sound like employer error, because redundancy is where the post no longer exists rather than terminating your employment on capability grounds. So you potentially do owe the money back. 
    A bit of back story would be helpful. If you want advice you need to give the full picture.
    Are any redundances being made in the company and any consultations happening? Or Is the employer considering ending your employment on medical/capability grounds and has that process started At all?
