MOT out of date and can't renew road tax

    So if you go through ANPR on the way to the MoT and get a fine for no tax, you can explain about going to/from MoT and they just let you off? You have no proof of it being pre-booked either unless the garage gets involved.
    If your claiming the benefit of an exception to the law, the onus is on you to prove that the exception applies. So yes you would have to provide evidence that you were indeed driving to an MOT. Which in practice means you provide the details of the garage and the police or DVLA phone the garage, who confirm (or don't) that that you have a test booked that day.

    Or if it's after the fact, you could just produce the MOT certificate/rejection slip which confirms when and where you had the test done.
