Can my boyfriend be my landlord and I still claim tax credit ?

Hi all. New to this. My boyfriend (who has his own home) is considering renting his other house to me and my children. He will get a proper agreement drawn up and all the bills and rent will be in my name only. He will not live with us (but may stay over a night or 2 a week, when my kids go to their dads) .
If we are not officially living together and he has he own house where he lays all his own bills, will I still be able to claim the tax credits I get as a single person?

However, if you claim Housing Benefit your local council may wish to satisfy themselves that the rental agreement is not contrived.

AFAIU one of the tests they apply is "if the tenant doesn't pay, would you evict them"
In this case, more of a test of the relationship than the contract.- All land is owned. If you are not on yours, you are on someone else's
- When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
- "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
