Credit card protection

  • As I have returned the goods I was asking if they would be able to assist with obtaining a refund from him/his bank.
The credit card company would only help if there was a breach of your consumer rights. As the company selling the dodgy (illegal) goods doesn't state that they accept returns, they are under no obligation to accept the watches back and issue a refund so the card company have no basis to attempt to reclaim your payment.

I can see this turning out to be a very expensive lesson about the pitfalls in attempting to buy illegal goods from dodgy sellers.

  • My question was relating to whether anyone had experience in whether the bank would be able to assist in getting a refund from him/his bank as it was a credit card purchase.
Would you ask your credit card issuer to assist in getting a refund if you had tried to purchase cocaine?
In reality, what you are asking is no different as both counterfeit watches and cocaine are illegal to sell in the UK or import into the UK.
It makes no difference that you thought that the seller was based in this country as what they are selling is still illegal.

As I have returned the goods I was asking if they would be able to assist with obtaining a refund from him/his bank.
The issue with that is that you need to be sure that Saudi has consumer rights that allow for the goods to be returned due to change of mind - if this were a UK seller then you would have that right- but would need to prove that you complied with the legalities of change of mind return, and can show proof of delivery back to the seller.

You haven't technically returned them at all, just refused to pay the duty on them, and that is an entirely different matter and even in the UK that might make things more difficult.

You can't even use the argument that you have followed the return procedure outlined by the seller and have been refused- as it stands the site has absolutely no terms and conditions that you can quote or even attempt to comply with.

At the very least to aid any possible claim you will need to show you have made an active attempt to  get the seller to refund- then possibly you could go to your card issuer and say they are refusing the refund. So start by trying to make contact (and keep full records as proof) with company asking for a refund - and keep asking. You really need to spend some time and effort on this if you have any hope of succeeding.

So that rules out Counterfeit chargeback. Due to "REPLICA". As that is a very clear statement that they are not the real thing.
Only option might be a non receipt of refund. But for that you need to have proof that the goods have arrived back with retailer. Proof of sending is not enough.
If you get that confirmation and have not got the refund after 15 days. Call you card provider.
