ANPR parking fine

Hi all I've read through loads of various threads on here over last few weeks but am struggling to write a good defence for court.
I parked my car in Adams Street ncp car park in Cardiff, car park was full after doing few laps of it I seen a family walking to their car so waited for their space when I went to pay the machine was down so tried downloading app to pay, this wouldn't download so payed by phone for 4 hours, I was back in car within the 4 hours but I didn't know you are timed from the moment you drive in, they say I was 15 minutes over the 4 hours. Anyway I appealed on their site stupidly giving my name as the driver (should have read up before appealing) they didn't respond to my appeal and the next letter I received was from BW legal. I basically told them to stop harassing me as it is not lawful then I had a letter from the courts. I'm determined I'm not paying a penny to them so need a good defence. Hoping someone can help me cause I'm not the best at stiff like this. Thanks

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

  • This is the reply I've had back after submitting my defence to the courts. I'm thinking there's no way out now and I will have to pay, any advice would be greatly appreciated. Thanks

you only have to pay if a judge says so, in court

everyone gets that template letter as they are trying to frighten you , its not personal, its part of the game you are in

check your status on the CCBC mcol website , you are awaiting a DQ from the CCBC in Northampton, eventually (not begging letters from B W LEGAL)

Respond saying 'See you in court, and while you express that your client will be claiming their costs in the event of persuading the Judge of their case, you are confident that the Judge will find for you and would they please inform their client that you will be seeking your costs - and here is the summary of those costs' (lay them on thick - see the advice on a costs Schedule in the NEWBIES FAQ sticky, second post.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Don't be silly, BWLegal are well known for this nonsensical junk.

Their client is confident they will win ?????   WHAT A JOKE .... Do their client know they have added a fake charge which will result in a spanking  ?????   Do their client fully understand that a CCJ can only be issued by a judge and NOT when BWLegal lose ... as they will.

Do their client not understand that when BWLegal loses they will have to pay costs to you
These are the things BWLegal do not tell you in their highly
    nonsensical letters

Complain to the SRA enclosing a copy of that letter, it is unbalanced and, imo, threatening.
