Parking fine

Have received a fine from a train station for a ticket that supposedly wasn’t paid. Parking was paid on card and the machine didn’t give a ticket just that it had been paid until 11.59 on the day it was paid on the machine. Didn’t see the charge come out on statement. Car is leased so charge goes to lease company who automatically pay it. We’ve now received the notice. Is there anything that can be done about this as seems like a complete ruse!

You sound sure that the lease company automatically pay. Unless this is due to some cast-iron contractual agreement, tell them to ensure that the charge is passed to the Hirer. They will almost certainly not supply the PPC with the documents which the PoFA specifies must then be delivered to the Hirer by the PPC. And that is the main reason why most Hire car POPLA appeals are won. Rather than me rabbiting on, check out the small 'hire car' section of the Newbie's thread plus other hire car threads on this forum.
There again, you haven't said which PPC this is so I've no idea whether POPLA is an option. Which PPC?0 -
Ah, just noticed that you said 'we' (i.e. the hirer?) have received the Notice - which, unless I'm missing something, will effectively be the Notice to Hirer. So it seems as if the Hire company have passed on the hirer's details. Did the NTH include all the documents listed in the PoFA schedule 4, paragraph 13? I'm guessing not.0

I have no idea what any of that means. We have a car on a 24 month lease. The leasing company automatically pays fines as the notices get sent to them as the owner of the vehicle. They then automatically pay the fine ( I have argued this with them before and said how ridiculous that is but that’s their policy ) it is a pcn given by Saba on behalf of govia. We are told that if we appeal successfully they will refund us. I’m unsure whether they have passed on our details as they just auto pay it. It is addressed to the lease company.0

OK, so this times out after 6 months and nothing happens, but as you say the awful thing is the idiot lease company just pay them.
You cannot appeal successfully, that is impossible with SABA as they offer nothing that is a proper, fair, appeals system and everyone loses that we see. Everyone...
First thing is to find out if the lease firm have actually paid. Even if they haven't, you are between a rock and a hard place as you can't prove that you paid because the payment wasn't taken from the card. So payment was not 'made'.
We have seen SABA revert to the lease firms even if a driver appeals, and they use the excuse that the byelaws hold the owner liable, thus they bombard the owner with letters till that owner pays anyway.
For once, I don't think there is an easy answer except to protect yourself in future NEVER use that lease firm again. You cannot be exposed to this risk due to their unfair policy.

Thanks. They’ve definitely paid it. Most lease companies use this way of dealing with fines tbh. Am thinking of trying to find cars resisters to them and setting my own parking company up and just sending them invoices.0

If the hire company do charge you improperly you can take them ot court, and/or complain to Trading Standards and/or their trade organisation.You never know how far you can go until you go too far.0

It is a lease company not a hire company. They simply pay the fine as per the instructions. This is very common.0
