flying freehold

we had offer accepted on house, only to find out after searches and seller completing info pack, did he declare house has Flying Freehold!! by law should he have told perspective buyers when they viewed the property?? we have now paid out approx £250 in searches and thinking to withdraw offer as do not feel comfortable knowing next door bedroom would be above our lounge :(

    The Estate Agent should have disclosed "material information" which they knew or should have known.

    As a "property professional", perhaps the EA should have been able to tell by looking at the property that there was likely to be a flying freehold, and asked the seller about it.

    So ask the EA if they knew it was a flying freehold, and if not why not. Or if they did know, why they didn't tell you.

    If the EA is a member of the Property Ombudsman Scheme and you complain to the ombudsman, the ombudsman might tell the EA to pay you compensation.  See: https://www.tpos.co.uk/consumers/how-to-make-a-complaint
