    what does your lease/AST say about parking? Does it mention the need to display a permit? If not then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.


    Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

  • OP - you would also argue that VCS failed to provide any service - as your bay was occupied by an unauthorised vehicle - which is why your vehicle wa sparked 
    Wht does your AST state abot parking? Obviously DONT just search for the single word "parking", but read the actual document. 
  • I am trying to obtain a copy of the lease agreement (as a tenant I don't have one - only a tenancy agreement). But the Building Management Company do post regulations about parking in each building (which presumably reflect the lease) only states that you cannot park in someone else's bay and that you must display a permit (I parked temporarily in an unmarked bay - basis for VCS charge) and was displaying a permit -- so I would argue I was complying with building parking regulations. I doubt that there has been any variation on the lease allowing VCS/Renshaw-Smith to set up its own rules -- and certainly not one that has been agreed by 75% of property owners. I could right to the Management Company requesting a copy of the lease but I have a feeling they will not respond/be helpful (not in their interest either?).

    Why are you assuming anyhting here? MCs make !!!!!! up all the time. Thats half the issue with residential parking parasites! 
    You can:
    1) ask your landlord for sight. If theyre sympathetic
    2) go to the Land registry and pay for a copy

    That is not a presumption which I would make, the MA of one of my properties think that they can ride rough-shod over the wishes of owners.

    l will get a copy of the lease from Land Registry. Does anyone know if a variation to the lease (e.g., changes of parking terms agreed with 75% of leaseholders) needs to be reflected in amended lease? That is, if I get the lease and read it through any terms related to resident parking rights should be reflected in it?
