Refund for an item which I haven’t received

I placed an order with Thetinyhuman on 24/01. I received a shipping confirmation email on 30/01. The items were sale items, and the website states that all items should ship within 14 days and dispatched items should be received within 1-4 days.

By 10/02 I still hadn’t received the order, so tried to contact the company on Instagram for advice (they are a small company who are very visibly active on Instagram). On 11/02 I tried to contact the company via the form on their website. On 12/02 I tried Instagram again, and received a response to say to use the website contact form. I responded to say that I had done but with no reply and was told that they would be replying to emails that day. Still nothing by 13/02, so I tried again via the contact form and requested a full refund of the order as I had waited long enough for the items and was now more concerned with getting my money back.

The company replied, apologised and explained that they would try and locate the order, but if that wasn’t possible they would ship again first thing the next day (14/02) with express delivery. I replied to say that I was only now interested in receiving the order if they could remove the original postage costs, and if that wasn’t possible then I requested that they cancel the order instead.

I chased a response on 14/02, and on 17/02 wrote again to request a full refund. I was tired of dealing with the company and no longer wanted the items, express shipping or not. On the same day they replied to confirm that they had issued a refund

I received a partial refund on 19/02 which did not cover even half of the order. On 21/02 I wrote again to question why the order had been only partly refunded.

Today, again after no response, I tried again on Instagram as a public comment, hoping that this would prompt the company to reply with some urgency. They deleted my comment, and replied by email to say the reason I had only received a partial refund was because the other part of the order had now shipped. I have been charged for shipping costs.

I would like to know, in terms of my consumer rights, where I now stand with this company. It has been a month since I originally placed the order, I no longer want the items because I have had to wait for so long, and in principle that I no longer want to have to deal with this company or give them my money. I will now also have to go to the hassle of returning, and I am already aware that this company don’t generally accept returns of discounted items and don’t cover return postage. I have been very clear on the fact that I would like a refund, which I have expressly stated a number of times. I have records of all contact that I have had with the company.

    The only advice I would offer is to check out companies before ordering from them.

    There is no company address, no telephone number and not even any indication of which country they are based in.
    Without this information, you have no way of knowing which consumer trading laws apply and you have basically made a payment (and given your credit or debit card details) to an unknown person or business.

    If you paid by Debit/Credit card then contact you bank and get a non-receipt chargeback started. As they have refunded something, you may have to send in some paperwork to cover the balance.
