    Criteria used  by DWP for this purpose which include:

    1. Living in the same household 
    2. Stability of relationship
    3. Financial support 
    4. Dependent children
    5. Public acknowledgement
    6. Sexual relationship

    The links take you to HMRC Tax Credit manuals, but HMRC state in their manuals that they will use the criteria adopted by DWP

    Where will we be be registered with council tax.
    What address is bank account registered with and where will  his mail be sent.

    This is likely to be one for a Decision Makers opinion.
  • There is no doubt that we are a couple.  I could not and would not deny this.
    However according to E2012 we do not meet the “basic conditions”. Ie we do not live together. My partner will be registered for all purposes with his new address, eg doctors, voting.  Everything in fact.  If we do not meet the “basic conditions” we cannot claim as a couple.  Eg Jane and Tom in the example where one is not over 18.
    This is the best opportunity we have got for us to get off benefits and whilst we would not lie eg say we were not a couple I do want to make sure that we can support ourselves.

    The only way to be sure is to claim and disclose the facts so a Decision Maker can decide,
