PPI mis-selling claim upheld but amount offered later changed

Options

Hello we are new to the forum and hoping somebody may have some advice. I have had a credit card for over 25 years and recently put in a claim for ppi mis-selling. I was sent a letter three weeks ago upholding my claim and offering £700. This money has not yet come through.

I was made redundant last year so actually I did make a claim against the ppi that was on the policy and I was awarded approximately £650. Despite this, I still put in the claim for mis-selling because I don’t believe the ppi was sold to me as optional, and I know that at the time it was taken out, I had a safety net to fall back on so I probably would not have taken this out voluntarily. I was appreciative of the money that came my way during my unemployment but still figured that over the whole 25 years (plus interest) I had probably paid far and above this amount in payments to the credit card provider, so I put a ppi claim in anyway.

Yesterday, I received another letter saying they have identified an error with their redress figure and have amended the £700 to just a few pounds. It seems they did not take into account (when giving their first figure) that I had already claimed on the policy. However, I have checked the information I provided to them on making my complaint and I made it crystal clear that the policy had already been claimed against, giving all relevant information and dates. If they give you a wrong figure (based on having ignored relevant information which has been freely provided), can they really then just change their calculation? I expect the answer is ‘yes’, but just wanted to get some views on this. If anybody has found themselves in a similar situation, what did you do and do you think it’s worth my time forwarding this on to the financial ombudsman?

That would appear to be the case.

The people dealing with the complaint and those that arrange the redress are you usually different.  So, they probably never saw it.

If they give you a wrong figure (based on having ignored relevant information which has been freely provided), can they really then just change their calculation?
Of course they can.  if they made a mistake that was lower (as has happened many a time) they could just say tough otherwise.

what did you do and do you think it’s worth my time forwarding this on to the financial ombudsman?
your complaint was successful.  You have no reason to go to the FOS.

  • They're correct to amend the amount to the right sum.

FOS won't overrule the factual figure. You can't have both a payout and a refund of premiums as you've asked to put back in the position of not having had the policy.
