Providing evidence in first appeal which has my name (registered keeper)

Hi guys - I'll be disputing a PCN from a car park where the driver failed to register vehicle registration details on the tablet inside. The keeper who was an occupant of the car has a genuine appointment card which has the keepers name on it. Can the keeper provide this appointment card as evidence while still withholding the drivers identity? Thanks

    First, edit your post to remove information about who did what/who failed to register details. Only ever refer to The Driver and The Keeper, who are two different people in law. 

    Do this before you do anything else!

    What is the name of the PPC please?

    Unless the vehicle in question has only one seat, then there is no problem with The Keeper being an Occupant of the car, just do not reveal the driver's identity.

    Have you read the sticky thread for NEWBIES yet? Send the initial appeal template you will find there in blue text from the first post of the NEWBIES. Send it unaltered, from The Keeper.

    Don't forget to complain to your MP about this unregulated scam.

    I would go in person and complain to the Surgery Manager (I assume an appointment = GP surgery with ParkingEye or CEL infesting the car park?) until he/she cancels this with one email.

    I have a genuine appointment card which has my name on it. Can I as the registered keeper provide this appointment card as evidence while still withholding the drivers identity? 

    Yep, you say that you were an occupant of the car, OR you redact the first name before scanning the card and you say this:

    A member of the family had an appointment and that card is attached as proof, and no-one and no sign drew anyone's attention to any need to somehow 'exempt' your car just to go to the Doctor's for a pre-authorised visit, and that you have complained to the Surgery about this and await cancellation confirmation.

    The name of the PPC is civil enforcement ltd
    Yes I have read the stickies and was intending to send the initial appeal template however my questions was brought about by the advice:
    You can (carefully!) add a little to the template above, 'in order to resolve the dispute I attach copies of...':
    Would you suggest attaching the appointment card or sending the template unaltered from the keeper? I could redact the first name as advised by Coupon-mad.
    I have been in person to reception, called reception & emailed the surgery manager and have yet to receive any sort of reply so I'm just getting my first appeal in order now in case it is required.

    Good, you have done nearly everything right so far. Just remember that parking scammers read this forum and have been known to identify posters from here and used that as evidence both at the appeal stage and in court.

    I therefore suggest you change the second sentence in your first post to something like this: -

    The Keeper who was an occupant of the car has an appointment card with their name on it.

    Hopefully you will have contacted the Practice Manager and/or Senior Partner. If the surgery has a Patient Participation Group or similar, complain to them as well.

    Do remember to make the complaint to your MP.

    Many judges regard failure ti register a VRN as a trifling matter, if they were to take this to court they might struggle, read this

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Thank you; yes I have read the NHS parking principles and have quoted them in my email to the Practice Manager. I also feel confident the signage does not meet regulations as the charge amount of £100 is not displayed prominently.'

    I will be sure to complain to my MP when this is over.

    Hi guys - I've been assured by the practice manager (after some chasing and cajoling) that 'on this occasion' she will send an email to the PCC. My question is; should I submit my initial appeal anyway in case she forgets or for some other reason doesn't get round to it? And if the answer to that question is yes, submit, then should I reference that she will be contacting them? Thanks in advance, this forum is truly remarkable! I've spent some time reading through various posts on various stages of appeal and it's fantastic to see what goes on here.

    Something like this:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I have made a complaint about your predatory conduct to your client landowner. The client, I have been assured, will be contacting you independently in this matter.
