As above
Its why you have to stay on top of this process, as the newbies tells you.
If you dont, a single piece of lost post can cost you.
The CCBC should have automatically stayed the claim, as the claimant has not responded within 28 days saying they want to continue.1 -
Le_Kirk said:If you have submitted a defence and it has been sent to the claimant and the claimant has told CCBC that it intends to proceed with the case, CCBC then send out a DQ (N180 form) with a deadline date on it. If you do not respond by that date , the claimant can claim a win by default. If MCOL only says defence received, it is possible that DQ's have not yet been sent out. In order to get a jump on the claimant, you can download your own DQ, fill it in and submit it to the CCBC and the claimant. Instructions for all of this is in the NEWBIE stick second post.
Thanks for that! I was hoping that the claimant would also have a deadline which states by when he has to respond to my defence? I remember when they sent me the paper copy of the acknowledgement of my defence being received they mentioned that they would contact me with further instructions, as in sending the DQ, but nothing has happened.0 -
It could be:
1) The C responded to the court saying "proceed", but the CCBC is still processingit, or;
2) The C did not do so, and the CCBC hasnt yet realised the claim should now be stayed as a result
In 2) , lifting a stay requires a £100 application to the court, and there is no chance the court will make you pay that even if you lose, as it has nothing to do with your side of the case.1 -

So is there anyway I can contact them, without phoning them, and ask them if the claimant has responded within 28days?0 -
Please re-read items 8, 9 and 10 in the list in my 23 February at 3:26PM post.
As others have said, file your DQ now.1 -
Email is the only way, if you think about it. But you dont need to
If you file your DQ theyll either accept it, or theyll return it saying the claim has been stayed.
Remember to file with the C as well.2
