TUPE RELOCATION OF PLACE OF WORK AND MILEAGE CLAIMS

My contract is being transferred under TUPE but I am also having to move place of work. The change in place of work isn't a problem in itself  - I'm employed on a peripatetic basis so will only go for occasional meetings etc - but I currently claim mileage from my employer at 45p for every mile over the distance to my current place of work. The new place of work is 20 miles round trip further so the amount of mileage I can claim will be reduced by 20 miles a day.  This will leave me about £1500 (free of tax) out of pocket p.a. - that's about 10% of my salary ( low paid & part time but a rewarding job most of the time!) . I thought purpose of TUPE was to ensure employees are not worse off after the transfer, but I am also aware since 2014 that relocation of workplace is not unreasonable under TUPE. Do I have a case to put that mileage claim should still be based on distance of existing place of work? Otherwise, tbh, at the level I'm paid, it's not worth doing!

Had the transfer not happened  but your existing employer had relocated 20miles away you would have been in the same situation so, in that sense, TUPE has protected your T&Cs.
You could propose a relocation  mileage allowance to cover the extra but, unless your existing contract says anything on the matter then that is down to the goodwill of the new employer

You are not £1500 out of pocket, only the cost of the additional fuel which amounts to about £650 per year with a car with average MPG.

Can you explain that? How would it be £1500 py if you only visit occasionally?

AIUI the OP claims mileage for all the work journeys she does to places other than the employers main office. Thus with a reduction she's losing up to 20miles x 45p per trip (£9)

The new company does apparently have a relocation allowance to cover a change of place of work which lasts for one year. I’m not sure I’ll be given it though but probably worth pursuing if they don’t agree to me using my original distance to work as the basis for my mileage claims. It’s just frustrating as the new company has been reimbursing my existing company all my mileage anyway as I do all my work on behalf of them anyway.
I’ll let you know the outcome.
