Limited capability element

Options
My son has received a payment from UC today saying it is the limited capability element owed to him . I'm very confused as from everything I have read you only get this element if you were claiming ESA before 2017 and he wasn't. He still has to go to the job centre but doesn't have to look for work. He had the work capability assessment in December 2019 although it was originally supposed to be October but they cancelled twice . Not only am I confused that he has received this payment but also that it says it is for the period March 2019 to May 2019 so he hadn't even been assessed then . Can anyone help me understand this  please

You also get it if awarded the Limited capability for work and work-related activity.

Not sure about the period though.

When did his claim first start? and when did he send his first fit note and has he worked at all since sending the fit notes?
  • Yes I read that you get it if also in the limited capability for work related activity  but he has been assessed as still able to do that  thank you for the info.
He has been claiming on and off for years. He was having problems last year and they told him he had to go for this assessment, he's never sent a fit note. But no he hasn't worked for the last three years . So I have no idea why this has happened . It doesn't seem to make much sense.  Any thoughts?

As he hasn't worked for 3 years then i have no idea why he would have received that payment. All he can do is either put a message on his journal or ring and ask because we could only guess what the payment is for.
  • Ok thanks we'll do that and find out why they gave him it
    Thank you for that
