PRA group CCJ awarded

pointandshoot said:I made an arrangement to pay PRA as Barclaycard sold it to them. They wrote to me at my old address and I said fine, but I want to see the CCA. Always worth asking - if they couldn't provide they'd have been told to do one. They provided it late Nov/early Dec. Once received, I rang up to make arrangements to clear it. As an arrangement had been made and I stuck to it, I didn't change my address. They didn't track me down - I gave them my new address to send the SAR to. Why would they apply for a CCJ if the arrangement hadn't been made yet? Surely I should have the opportunity to pay (which I intended to, and still will do so) before they applied for a CCJ?
option 1: settle the debt in full within thirty days of the judgement date;
option 2: pay a fee and apply to the court to have the judgement set aside. You have to give a pretty good and convincing argument for this. In some (no doubt rare) cases a claimant may consent to the CCJ being set aside, which would make the process easier. Information in the SAR may help you here, for example if it shows PRA Group deliberately didn't send papers to your new address.
After going through PRA Group's complaints process you can take your complaint to the FOS. A judgement from them in your favour may help persuade a court to set aside the CCJ.
There probably isn't going to be a quick fix to get this sorted out.0
