Unfair terms of removal company

Last August 14th I moved house and employed a removal company to moved my possessions. I paid for insurance. A piece of furniture was broken, I believe beyond repair. It was a hardwood telephone table. The men presented me with the many pieces and said sorry. Having an enormous amount to do I put the pieces to one side and set to unpacking. Some weeks later I researched a replacement, came up with an approximate cost of around £300. I phoned the company about 15th or 16th September to initiate a claim only to be told I was out of time! Out of the goodness of his heart, ha ha he offered £40. I was told I could try arbitration, through The Furniture Ombudsman and was hopeful. They were quite unhelpful and rejected my case. Do I still have a case in the small claims court? Unfair terms and conditions?
