Help with Consumer Rights on Laptop

Hello - new here I hope I am in the right place - if not please advise.
I bought an Acer laptop in December and 5 weeks later I had a major problem with it - turning off and really noisy fan -  I returned it to Argos but unfotunately it was 1 week after there 28 day money back period.  They advised to contact Acer and gave all the details to me - I did so and was advised as it was under warranty to send to them for repair.  Did this - 3 weeks later phoned them as it was showing as still in repair mode -  they advised they were waiting for a part -  I did say at this point how long are you allowed to keep my laptop can it be months !! I was advised that NO if we cannot repair within 4 weeks we offer money back .     I left the conversation - i have now just phoned them - it is now 5 weeks tomorrow that they have had the laptop - they are still waiting for part for repair and I said it was not good enough and that I want my money back - I need it for work and at over £400 it is not good enough that I have had only 5 weeks limited use in a 10 week ownership !! -  they told me that they would not refund money but could send computer back to me (unrepaired) - or I just had to wait.   Please help me I am stuck - I am feeling like they have stolen my laptop and I cannot do anything about it

    Be careful saying you need it for work as that can make it a b2b transaction and some of your consumer rights wont apply.

    Acer are not liable to refund as your Consumer Rights are against the vendor .
    They have not stolen your laptop as they have offered to return it .
  • sorry I realise they have not stolen it - it just feels like it -  are you saying that I should ask for it back even if it is not repaired and then ask Argos -  because Argos said they could not do anything about it as it was past their 28 day policy  - thank you both for your comments

    The turning off and noisy fan is usually heat related and often caused by built-up of dust inside the unit.
    This is not usually a sign of defect with the product, since dust is a natural part of the air around us.
    You didn't do something like leave it on the floor or the bed while it was on?

  • Hi No - it was noisy from about the 2nd week but was not until it stopped working that I went to return -  I believe it may be the motherboard they are changing which is why they have had it for a while waiting for the part to come in - it is just so long and I am without my laptop !

    Their 28 day policy is just for change of mind returns, Argos offer a one year warranty with all their products so just claim on that.

    The problem with doing that is it may drag out the repair even more.
    If you get the laptop back, Acer may well cancel the order for the replacement motherboard and as Argos won't do any repairs themselves, they may well simply send it off to Acer where the part might have to be ordered again.

    I suspect that you do not  have this promise in writing and this may be a lesson for you to learn

    It was probably a mistake or misunderstanding by the Acer employee.
    As the laptop wasn't bought directly from them, they wouldn't be able to give the money back as they didn't receive any money from the OP.
    What they may do is to issue a returns authorisation to Argos which states that if the laptop goes back to them then Acer will refund or replace Argos.
