Hi 
my ex employer has mislaid my P45. I know how to get y to he information contained on it as it’s available on my final payslip. However, despite the fzct they say they’ve sent it, I don’t have it. I am concerned about my personal information contained on the P45 being in the wrong hands
is my employer breaking any privacy or GDPR regulations?

  • Sadly I don't think we can go anywhere, all I've gleaned is that anyone expecting a p45 can now expect one in the click of fingers - I too had an ex employer who reckoned they just produced a p45 on the 20th December and just left it on my desk - couldn't confirm time of day and it was interesting as I certainly didn't start the day knowing for sure I was leaving!. They got the beauty of not paying notice pay, telling their client lord only knows what in blame passing, aren't having to write reference, were not bothered in January and I was just met with utter unhelpfulness, it was no different to the working day with them.
    Thankfully in the end, and ironically after having to pass security, the accountancy firm behind my employer supplied the p45 and missing payslips after raising a complaint about the nerve to withhold financial information and should I have took such early production of a P45 to mean actually I'm due notice pay.  
    I came to the conclusion my leaving was premeditated and the person in charge 'must' have put my P45 in a christmas card sickeningly, makes my skin crawl.  But I did have a lucky escape.
