Leak after exchange

Hi all. We exchanged last Wednesday with completion this Wednesday and woke up this morning to water running down the wall and across part of the ceiling in the lounge. It's underneath the section where the bay window roof sticks out so is either a roofing or gutter issue.

Thankfully we have emergency home cover so have logged this with the insurers but they won't send someone today as it's still too windy so I'm now panicking this won't be fixed by completion and what do we do about the redecoration costs? Can we offer a retention on completion for the buyers to supply invoices for the decorating costs ? 

I'm obviously going to let me solicitor and estate agent know about the situation tomorrow morning but in the meantime am totally panicked about what happens if they haven't carried out the repairs by completion! Does anyone have any experience of this?

    Isn’t it the buyer’s insurance that needs to pay as you have exchanged?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    The buyer is responsible for buildings insurance from exchange. Technically the seller could cancel their buildings insurance but it is not recommended. Does your own insurance company know that you have exchanged? They may require the claim to go through the buyers insurance.
  • Yes they know we've exchanged. We have a responsibility to maintain the property to keep it the same as it was on exchange. 
  • What a mega-pain - sorry you're going through this! I guess, for now, the only thing you can do is ask your insurers where you go from here? It sounds like an ensured risk, as opposed to wear and tear, if the leak was brought on by the storm.
