Phone call from Solicitor connected with ZZPS

Hi there,

I received a call today in connection with a parking charge notice. I have received a few letters last one being from a company associated with ZZPS. Now today I received a call and I answered because I use my mobile for business. I have no idea how they have got my number because I have never contracted anyone regarding it. The notice was in regards to a vehicle my vehicle but it was the wrong registration was typed in to the computer as the registrations were
mixed up. This was communicated to the establishment at the time but following contact with them twice they have not bothered their backside resolving it. It has now went to this solicitor connected with ZZPS. When they called today they went through the contravention but I told the guy I know nothing about it so can help him. He proceeded to tell me I have refused to pay but I told him I know nothing about it and cannot accept liability for something I know nothing about. He then repeated I would be marked as a refusal to pay and then hung up. This ticket was issued in Scotland but what I’m looking to know is that even though as the keeper in Scotland I have not told them who was driving can they still pursue this without an admission of liability or without nominating a driver?

    Who was the original parking company? (ZZPS are a debt collector ... they cannot take you to court; the parking company are highly unlikely to take you to court).

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    on holiday at the moment I would need to check back. They said the usual crap about expecting county court documents in the post etc. To be honest they can ram their court documents  if they come I will return them or just refuse to sign for the recorded delivery.

    QDR Recoveries is a trading name of QDR Solicitors Limited, who are a wholly owned subsidiary of Wright Hassall LLP. Aberdeen Trading Standards might therefore be interested in adding Wright Hassall et al to the list of defendants.

    Wright Hassall are well known for threatening litigation on behalf of their client ZZPS Ltd. However, ZZPS Ltd are just a debt collector and have not been assigned the debt by Civil Enforcement Limited. It is no therefore clear what right Wright Hassall have to instigate any claim or to transfer to their 'legal partner'.

    Only the other day QDR were given a good spanking in court for their rubbish

    BUT if you ignore court papers and fail to appear, you will get a CCJ against you and to allow that to happen would be so stupid

    Only a complete and utter fool would return court documents, what a stupid thing to say.
    Love it when the likes of QDR or DRP say they are going to mark up as refusal to pay.
  • Ok no problem thanks for your input. What would you recommend if court papers being issued were to happen? I was not the driver of the car at the time and I would not and shall not be paying for 1) a ticket issued for someone else making a mistake and 2) because the establishment where it occurred were made aware of the mix up by the driver but didn’t bother to correct it.

    you follow the simple procedures system and fight the court case, on the basis of being the keeper but not the driver

    You will not get county court papers, if you are in Scotland. Are you?  I know you said:

    Which parking firm? Some never file claims and some certainly won't try if you stay in Scotland.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
