Test Drive a car, got a ticket that was not mine

Hi Guys May 2018 I went to a Ford showroom to test drive a car. I had the intention to purchase but my credit failed. Months later I received a log book, I automatically sent back DVLA stating car did not belong to me and that they need to contact Ford  a month later I received a  parking ticket in an area unknown to me. I went directly back to Ford they said they would look into it. Wrote to London Transport explaining I never owned car go  to Ford. In the meantime the ticket has increased. New manager at Ford he said he would look into it. . My mum died in March 2019. My mind was not on the ticket.  The ticket escalated. DVLA wrote back stating it is error the car did not belong to me. June 2019  a bailiff knocks my door at 7am not expecting this, he puts his foot in door comes into my home with my children and demands I pay £513 or goods seized I showed him DVLA letter stating car not belong to me. My husband had to pay with several cards to get him to leave it was distressing my children were very upset. I ernt back to Ford faced them another new manager looked into it . Came back to me in December and said he would refund me back as a GOODWILL GESTURE.  They have caused me stress anxiety my son ask about valid my husband has been out of pocket, surely they should be giving me compensation as it is obvious its ability admu  weror, fraudulent to use my name for a car not purchased  pls help me as I want to reply to their legal team who say I have only 14 days to accept their offer with no explanation from Ford of reasons why this has happened in the first place .

  • Your priority is to get refunded for what you needed to pay, so accept that offer.

    If you want to raise a separate complaint afterwards, then do so.  But don't suggest to them that they've acted fraudulently, as that would be both incorrect and mad. Just stick to the facts.

    This is not a legal advice forum. Since bailiffs have been involved at some point I suggest you contact Sheila at Bailiff Advice Online. She posts here as Herbie21 here on MSE and has a good reputation. Make sure you use the website with the open law book on it's main page as there is another company with a similar name.

    The car doesn’t have to belong to you for you to get parking fines or speeding points/fines etc. 

    Instead of wasting time on who owns the car, you need to prove you were not driving the car at the time. Does the dealership keep records of when the car was on a test drive and when you returned it? That’s the avenue you should have gone down.

    Did a private parking company send you a private parking ticket?  If so please read this.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    What EXACTLY does the offer from Ford state? Fulla nd final settlement What?
    You have a very, very rambling long bit of info, and others seem to have missed that it was all paid
    If you reckon you have a good case, and suffered MORE damage than jus thte raw amount of money, then COUNTER OFFER to Ford. They will be expecting this

    Apologise for rambling.
    The letter states:
    Whilst our client reiterates its apologises about the situation.we cannot reasonably agree that it should consider itself liable to offer you further compensation whether suggested  or at all.
    We respectfully point out that the penalty charges which you may have received would have included details of the process  by which they could have been challenged or appealed.
    If you had done so, if these matters had been brought to our client attention rather earlier then bailiffs would have been avoided. 
    I DID GO TO FORD WHEN I FIRST RECEIVED TICKET THE MANAGER SAID HE WILL DEAL WITH IT. I HAVE ENAIL PROOF FOR THAT.
