UKPC Should I let them take me to court

Hi,
Could someone please help! I have receive 3 parking tickets from UKPC for parking on a verge on yellow lines at the end of the lay-by by my block of flats. There is a sign next to it to say you are not allowed to park on the verge but below are a few points:
- we have one space allocated to our flat and on one occasion someone was parked in my space. It was evening time and dark and I had my 10 month old baby in the car and it was pouring down with rain. There was no visitors space to park and I can’t park in someone else’s space. So in this situation I parked on the verge and got my baby in the house and someone came round and sat with my child while I moved my car. I was parked there for 20 mins and got a ticket.
2. My second ticket was my BF at the time came around and had to park in my space because there was no where else for him to park and the last two times he parked on the streets behind our flat he got his van broken into and lost thousands pounds worth of tools. So I let him park in my space and again I parked on the verge and got another ticket.

in these circumstances, where else would I go? I also have had my car broken into twice when parking at the street behind so I wasn’t going to park there with my sons car seat in etc and risk for the third time getting broken into. 

UKPC was patrolling our street a couple of years ago but their was an appeal from the residents to get them removed and they were gone. If I remember correctly we received a letter from the property management (not the people who provide our contracts) saying UKPC are going to be patrolling the street again. I do not understand who agreed for them to come back. 
Someone who lives in another block across the road was taken to court by UKPC for £3k worth of parking tickets ( their made up value) for parking outside the bays but she has told me today she won her case due to her lease not mentioning anything about parking and where she can and can’t park.
In my situation, I do believe the property management of the flats sent a letter to say UKPC are back and the signs do say don’t park on the verge so have I got no chance and have to pay the fine? My tenancy agreement doesn’t haven’t anything about parking on it either.

i have appealed two tickets and they rejected it and sent them to a debt company who have added £100 pounds into the ticket.
i have two letters about a parking fine but I actually never got the parking ticket on my car so I have ignored this one for the money.
shall I ignore the debt company and let me try take me to court or have I not got a leg to stand on?

please help as I am a single mum and completely stressed from it all!

  • I have looked at my Tenancy agreement and it doesn’t mention parking at all. Could it be on my contract? I have emailed the estate agents to get everything sent to me again just to ensure I am looking at everything.
    I stupidly gave the debt company my bank card details the other day to do a finance plan for one of them as I was so stressed out. But I am going to send them a letter tomorrow to say I do not authorise the payment.

    OMG ...... contact your bank first thing in the morning to cancel this as you have been scammed

    You cannot say you did not authorise this because you did
    More so, you will probably bullied into paying.   What did DRP say to you ?

  • Can I not say I do not want them to go ahead with the payment? Tbh I am going through a close family bereavement very recently and when I called DRP I was pretty much shouting saying I have appealed with UKPC and I want to settle with them ( I know you can’t when they have gone to DRP) and I was saying I don’t understand why they have added £100 on top of my ticket etc and they said I can’t appeal against it with them and UKPC rejected the appeal and just said you can do a finance plan to settle the fine. They were rude, but I wasn’t in the right state of mine and just said ok i will do the finance plan and gave them my card details. First payment comes out on the 20th. I want to stop the payment and then ignore their letters as per the link tread you sent. But do you think this will go to court?
    I did send UKPC another appeal letter last Thursday, do they have to respond to it?

    How much was the ticket for and what were DRP asking for
  • Ticket £60 originally if paid in 14 days then it went up to £100 and DRP asking for £160 
  • Shall I just call them and ask them to stop the payment?

    I think you will find that the ticket was £100 WITH a discount if paid within 14 days
    Therefore DRP has added £60 which they have no legal authority to do.
    Yes you need to tell DRP that you withdraw your authority to take payments on your card
    Your reason is that you were unfairly pressurised and at the time, you were not made aware
    that the added £60  is unlawful under POFA2012.
    Who applied this added £60, was this DRP or instructed by UKPC
    DRP should now cease contacting you and pass this back to UKPC. DRP should advise UKPC that any claim by them where the false £60 is added, will be treated as abuse of process.

    Advise your bank and give them a copy of your letter/email to DRP.  and confirm that your authority has been withdrawn
