Will QDR solicitors take me to court? Help please

Hi, would appreciate your advice please.

I changed jobs in August 2019 and started working in a new hospital, part of the process involved doing some training in September another building that was close to the original hospital. I parked my car there and didn't pay the parking fee as I thought I was joining the list for parking permit and because it was mandatory training it would be covered by the hospital.

Fast forward to now I have received several letter initially from ZZPS Limited who were acting on behalf of CIVIL ENFORCEMENT LTD asking for payment of £182.00. I ignored these letters as I have been advised to by several people and then I have received  a letter from from QDR Solicitors in saying that

' We have been instructed by ZZPS Limited who are acting on behalf of CIVIL ENFORCEMENT LTD to in connection with the full recovery of the debt, which has been occurred following the failure to repay the PCN, and we require you to make full payment within 14 days.

Failure to make payment in full or contact us to discuss repayment of this debt may result in us recommending to our client that we pass this matter over to our litigation department. This will mean that they will look to obtain a CCJ against you'.

It has almost been 14 days now and to be honest I'm quite nervous I definitely do not want a CCJ as I will be looking to put a deposit on a house in the next few years. Should I just cough up or wait it out? Is it true that if it does go to court and they win, as long as I pay the full amount I can have the CCJ removed? What is the likelihood that it even will go to court, can this happen or are they just trying to scare me?

I contacted my hospital PALS department and they are saying the car park and building I visited is part of another trust and so not covered by them and that I have to pay, in fact they were very dismissive and not helpful at all. I have been getting calls from QDR which I have ignored so far, but one of my friends did tell me they knew someone that kept ignoring parking charge letters and did end up getting a CCJ so I don't want this to happen!

I would appreciate your advice, thank you!

CEL are very litigious but, in order to win in court,  they have to comply with NHS guidlines

    https://www.gov.uk/government/publications/nhs-patient-visitor-and-staff-car-parking-principles/nhs-patient-visitor-and-staff-car-parking-principles

You only get a CCJ if the PPC taskes you to court, wins, and you do not pay.  Have you not read the stickies

Uf the solicitors is harassing you complain here

    https://www.sra.org.uk/

Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

You never know how far you can go until you go too far.
  • So there's no point paying now it seems. Will the price be the same if it does go to court and they win? May as well wait to see if it goes to court, do you think it is a reasonable case to defend in court?

My main defence is that I was parking at a hospital park required for my job which happened to be part of another trust, so wasn't covered by my hospital. Easy mistake to make in my eyes.

QDR ????? Cloud nine dreamers if they really think that ZZPS can instruct them The so called debt does not belong to ZZPS, never has and never will ?.  ZZPS are just time wasting muppets with zero power.
Only CEL can instruct a legal .... NOBODY ELSE ???
You can see that QDR don't have a clue ....... what nonsensical rubbish to say "they will look to obtain a CCJ against you" ......   that is the job of a judge
But hey, just look what QDR have done, they have faked an extra amount  .. making £100 into £182.
THAT'S ABUSE OF PROCESS BY QDR and they have already been spanked for abuse of process

QDR (Part of Wright Hassall solicitors) spanked in Warwick court
    for ABUSE OF PROCESS

Wright Hassall by the way are shamed legals, they own QDR ......  There would be no reason not to alert the court of this

You carefully read the abuse of process thread
