Tenancy Renewal Fee

Hi,
I’m looking for some advice. We’ve been in our rented accommodation for 3 years with our tenancy reviewed every 12 months. We’ve always had to pay £120 fee each time we’ve renewed. Our next renewal is next month and the letting agent is still requesting the £120 fee. Is this in breach of the Tennacy Fees Bill that came about last year?
Thanks

If the fee is listed in the current contract and it was created before 1 june 2019 then yes they can charge. However you do not have to agree and the contract will roll on to a monthly contract until they choose to try and evict you.You can only be charged for renewing your tenancy when your fixed term contract ends if you signed a tenancy agreement before 1 June 2019 which says you have to pay a renewal fee.
You can't be charged to renew a tenancy unless this was stated in your previous contract.https://england.shelter.org.uk/housing_advice/private_renting/letting_agent_fees_for_tenants
