The mechanism to defend is to say “sue me”, get the case transferred to the local county court and take time off work to defend. The defendant would need evidence of why the claim is too high. Defending whiplash or time off would be very difficult. Excessive hire car charges woukd get kicked out in court do that would’ve worthwhile.0

This is risky for the insurer. They are good at writing threatening letters but they have no idea whether the person can or will pay or will end up paying £1 per week. They don’t always take people to court, in you family members position I would deny liability.
