Part-time lodger affecting discounted council tax?

A friend has asked if, in about six months or so, she can start staying with me for four or five nights a month.  My first thought was what to charge her but while thinking about this I thought would my single persons council tax then be invalid.
I currently work full time and live on my own.
My friend works full time but her main residence will be in France and she is spending the rest of the month either in France or at a hotel. Obviously my plan is to call the council tax department in the morning but I just thought I would ask on here in case anybody knew what or if there is any kind of stipulation on people staying semipermanently.

  • I believe if it’s her only UK residence then she will indeed count as a resident for council tax.

    if she has another main residence in the U.K., for example if returned to a family home at weekends where she was liable she would not count on yours. However hotels and France wouldn’t count.

    What needs to be looked at is whether or not she is resident in the property - this is a specific term, it requires that her 'sole or main residence' in within the property. If her 'sole or main residence' is at the property then you would lose your discount.
    If her 'sole or main residence' is not in the property then she cannot be resident, it matters not where her main residence actually is, it's a matter of fact (Parry v Derbyshire Dales addressed part of this issue). There's no specific bar on a person having their 'sole or man residence' for council tax purposes overseas.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
